Louisiana's 1991 Act. 377, UCC Amendments Bill, effective 1/1/92, as UCC Article 9, Sec. 505 (3), allows Secured Party to preserve deficiency rights if: 1.) The release document includes a deficiency rights preservation paragraph and 2.) Lien holder's contract includes a preservation of deficiency rights clause. A post-repo. Notice to the Debtor sent within 20 days of taking actual possession will also serve to preserve deficiency rights provided the Security Agreement contains a deficiency provision.
